Q. Spa-Addicts.com Indemnification
A. Any customer must fully accept the indemnification of Spa-Addicts.com when purchasing any spa special or spa service provided by any day spa, medical spa, resort spa, destination spa or club spa promoted on this website. Any incident occuring between any spa (of any type) promoted or listed on this website and any customer referred by Spa-Addicts.com is strictly between the said spa and the customer and completely independent of Spa-Addicts.com. Spa-Addicts.com cannot be held legally responsible for any incident between any spa or customer as a direct result of this website.

Q. How will the sweepstakes winner be notified?
A. Winners will be notified via email and be listed on the website every month. They have one week to respond before we will contact another winner.

Q. How do I earn chances to win?
A. There are three (3) easy ways you can be awarded sweepstakes entries: 1. You need to initially register as a spa-addict thus entering you into the first month's sweepstakes. 2. Tell-an-Addict! If you refer a friend via "tell-a-addict" and you are a registered member, you will automatically receive an additional entry. 3. You may use the "Spa Here Lately?" feature to submit when and where you spa'd. This will earn you 2 entries. To be entered into the sweeps the following month, just "tell-a-addict" and earn a new entry into the sweeps.

Q. How frequently can I enter to win?
A. The sweepstakes will run each month. Remember, you must be registered to participate online, and each month you must renew your participation into the sweeps by earning new entries. You will be automatically entered again when you log-in, or when you use the "tell-a-addict" feature (one entry per email sent) or the "Spa Here Lately?" feature.

Q. Does spa-addicts.com automatically register me for the sweepstakes each month?
A. NO. Though you do not have to register again as a member, you have to register into the sweeps again each month. You do this by using our "tell-a-addict" feature and earning new entries into that month's sweeps.

Q. What prizes are you giving away?
A. One spa package per month and prizes which are determined each month.

Q. When will the winner be chosen?
A. The monthly drawing dates for the promotion change but are around the 15th of each month. The winner is notified and posted to the site under Become an Addict's Sweepstakes page.

Q. Does spa-addicts.com endorse the Red Hot specials here?

A. Yes, the spas promoted as Red Hot partners are endorsed by Spa-Addicts.com. However, Spa-Addicts.com cannot be held responsible or liable for the outcome of the specific spa service or spa experience provided at these spas.

The spas listed via Red Hot specials and featured as a Spa-Addicts Getaway have been recommended for a variety of reasons:

First, the spa in question has received press and endorsements from credible publications, TV or papers in their local markets. Based on these third-party endorsements, Spa-Addicts.com has enough reason to believe that these spas are reputable and professional and thus worthy of being invited to be included in our Red Hot specials.

Second, the spas featured with a Red Hot Special have been established as distinguished and/or popular spas in their local markets.

Third, should the spa be new, the owner or manager has impressed us with their knowledge, expertise and approach to building their business.

Therefore, from any of the above reasons, it is our belief that our Spa-Addicts would enjoy a Red Hot special at any of these spas.

However, we cannot guarantee that each individual experience will meet all of the consumer's expectations as spa employeesmay differ in terms of experience and style. Should there ever be a situation that is less than favorable for any Spa-Addict, we want to know about it and will bring any questionable situation to the attention of the spa owner. Q. Does spa-addicts.com endorse the spas listed in the National Spa Directory here?
A. No. Many spas may enlist themselves without our knowing them "personally." This Directory is a service to provide users with the most comprehensive spa listing service possible, and it is impossible to research every spa that may sign themselves up. However, we welcome your feedback so that we may know how these spa experiences are for you. Should they be less than favorable, we would like to know. Should they be more than favorable, we would like to know that as well. Email us at customerservice@spa-addicts.com.

Q. The spa says the special expired. What can I do?
A. If the spa says the offer has expired, please make sure that you "empty your cache" on your computer as you may be viewing expired webpages. The spa has the right to change their special monthly, providing they give us advance notice so that we can inform you via our website and through our mid-month newsletter. See below.

Q. Some specials that originally were seasonal specials, such as "Winter Specials," ended early. How do I know if a special will end early?
A. Every month on the 16th, we post a Red Flag icon that says "Ending this Month" on the spa's Red Hot special page, should the spa be ending the current promotion early and changing the following month's special. The spa has the right to renew their offer as long as we have advance notice so that we may provide this information immediately to you. So, please check back on the 16th. OR, register as a spa-addict and opt-in for our newsletters, as we announce those spas ending their specials early in our mid-month emailers.

Q. The spa did not honor the price on the special. What can I do?
A. One of a few things may have occurred. First, always confirm the spa-addicts price on the website when booking. If you are told the spa-addicts price is incorrect, please ask for the correct price and then contact us via email immediately so that we may research it right away. Either the receptionist may be new or have been misinformed, OR it could have been a mistake on our part. Either way, we will provide you with the correct price immediately. Second, we may have made a typo on the price that had gone unnoticed by both the spa owner and Spa-Addicts.com up until your calling it to our attention. Therefore, contact us immediately with the discrepancy and allow for us to research and correct it ASAP. We will inform you quickly as to the correct special price.

NOTE: Spa-Addicts.com, while sincerely apologetic for any price or other mistake, will not be held accountable or responsible for financial compensation.

Lastly, should the price be correct on the website and the spa is still not honoring it, we will pursue the matter with the owner and should it not be honored, the spa could be dismissed from the program.

In all istances, please contact us immeditely via customerservice@spa-addicts.com so we may research the issue.

Q. Can I use a gift certificate from another program to purchase a Spa-Addicts Special Package?
A. No. The Spa-Addicts Special offers are not to be combined with any other promotions, discounts or gift certificate programs.

Q. I called a Spa on the Spa Directory and they were unaware or confused about my Spa-Addicts special offer. What do I do?
A. Contact us immediately via email at customerservice@spa-addicts.com so we can notify the owner. It is probably a simple miscommunication that we can clear up for you right away.

Q. I had a problem receiving my VIP Card. Who can I contact?
A. Please contact the VIP Department at 1.866.HAV.2.SPA (428-2772) during weekdays between 10 am - 6pm EST. We will help you regarding any problems with your card or using it. Or you can email us at customerservice@spa-addicts.com.

Q. I had a problem using my VIP Card as the spa did not honor the VIP Extras. Who can I contact?

Q. I was told that the VIP Extras had changed. How do I know?
A. We will post a Red Flag icon that says "Ending this Month" on the spa's VIP Extras page, should the spa be ending the current promotion early and changing the following month's VIP Extras. The spa has the right to renew their offers as long as we have advance notice so that we may provide this information immediately to you. So, please check back on the 16th. OR, check the spa's VIP Extras page before paying the spa a visit.

Q. I forgot my password. What should I do?
A. We would be happy to email your password to you. Simply email the webmaster@spa-addicts.com with the email heading FORGOT THE PASSWORD. Once you fill out the required information, we'll email your password to you.

Q. I answered "Spa Here Lately?" on the website. What does this do for me? Will I hear from someone regarding this?
A. You will receive points into our monthly spa sweepstakes. Plus, you may be contacted via email by the staff of Spa-Addicts.com in order to provide confidential information about your experience at that specific spa. This is an important way that Spa-Addicts.com may keep a "pulse" on the "real" spa experiences that spa-addicts receive as a result of the website's direct spa referrals. NOTE: This information is only to be used for Spa-Addicts internal purposes or to help a spa pinpoint areas where improvement may be necessary. Should a user provide false information and claim that they received a spa experience when they actually had not, should the user win the spa sweepstakes, the winning will be void.

PARTNER INFORMATION

Should the spa not honor its specials to spa-addicts consumers, Spa-Addicts reserves the right to suspend or cancel contract.
Money will not be refunded under these circumstances.

Should a spa be involved in a lawsuit regarding business ethics or practices, Spa-Addicts.com has right to suspend business until the matter is settled.

Should spa consumers have complaints and critiques of spa, these comments will be taken seriously by managment and communicated to the property owner. Should Spa-Addicts feel that these complaints warrant immediate suspension, Spa-Addicts.com reserves right to suspend business without warning.

SWEEPSTAKES RULES

NO PURCHASE REQUIRED TO ENTER OR WIN. U.S. ONLY. VOID WHERE PROHIBITED.

1. Eligibility: The Monthly Spa-addicts.com Spa Intoxification Sweepstakes (the "Sweepstakes") is open only to legal residents of the Continental United States (and the District of Columbia) who are at least 18 years of age at the time of entry. Spa-addicts.com, and any additional promotional partners and their respective related companies, as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. Subject to all federal, state and local laws and regulations. Odds of winning in this particular drawing depend on the number of eligible entries received for the drawing. Void where prohibited.

3. Agreement to Official Rules: By participating in the Sweepstakes, each entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of Sponsor, which are final and binding.

4. Timing: The Sweepstakes begins at 12:01 a.m. Eastern Time ("ET"), on the 1st of each month and ends at 11:59 p.m. ET, on the last date of each month (the "Promotion Period").

5. How to Enter: There are four (4) ways to enter the Sweepstakes, which will consist of twelve (12) monthly drawings: a. To enter online: Go to http://www.Spa-addicts.com and register to become-a-addict, and you are now entered for the drawing and have earned one entry FOR THAT MONTH ONLY. b. Once you are registered, you will also receive an entry for each time you refer a friend via "tell-a-addict" email or use our "spa here lately" feature. These points will be applied to that specific promotional period's drawing only; i.e., the MONTH you refer a friend is the month's drawing for which you will be registered. You must come back each month and earn new entries into the new month's sweepstakes by using the above mentioned featuresagain. This will register you for the sweepstakes of that month, and you will earn new entries into that month's promotion. Each time you email a friend(s) or use the "spa here lately" feature throughout the entire promotion period, your email address will be recognized via the spa-addicts.com database. You may only refer persons with whom you have an existing personal relationship and to whom email from you would not be considered spam. Also, should you submit that you had a spa service via the "spa here lately" feature, your visit will be verified with the spa. If there is a discrepancy and you are not on record for having gone to the spa, your entry will be void. Each entry of any type will be eligible only for the monthly drawing in which the entry is received. c. To enter by mail: Hand print your name, address, day and evening phone numbers, e-mail address, age and "Spa-addicts.com" on a 3" x 5" piece of paper. Mail it in a hand-addressed envelope to the "Spa-addicts.com Sweepstakes", PO Box 3451, Hoboken, NJ 07030 . LIMIT: one (1) card per separately mailed envelope. You may enter one (1) time via this method each monthly Promotion Period. Each mail-in entry you submit will receive one (1) entry into the Sweepstakes. Each mail-in entry is eligible only for that monthly drawing in which the entry is received. For all entries: All online entries generated via registrations and refer a friend emails and mail must be received during the Promotion Period. All mail-in entries must be postmarked and received by the close of business on the last day of the month of the promotion. All entries become the exclusive property of Sponsor, and none will be acknowledged or returned. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, illegible, misdirected or postage-due entries, which will be disqualified. Use of any automated system to submit entries is prohibited and will result in disqualification. In the event of a dispute as to any online entry, the authorized account holder of the e-mail address used to enter will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder.

6. Drawings: At the end of each of the twelve (12) months of the Promotion Period, a random drawing from amongst all eligible entrants will be conducted on Sponsor's behalf by an independent judging organization whose decisions as to the administration of the Sweepstakes and the selection of potential winners are final. Every entrant's chances to win are increased by each entry he/she has received for that month's promotion. EX: If Entrant A has twenty-five entries and Entrant B has only one entry, Entrant A has twenty-five chances to be randomly selected as the month's winner and Entrant B has only one chance to be randomly selected. Once an entry is received by any method, it will be eligible for only the drawing in the month in which it was actually received. During each of these monthly drawings one (1) randomly selected eligible entrant will be selected to win a prize described in paragraph 7 below. Entrants selected must comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements. Except where prohibited, potential winners must sign and return to Sponsor, within ten (10) days of being notified via email, an affidavit of eligibility, if applicable, and liability/publicity release in order to claim his/her prize, if applicable. If a potential winner cannot be contacted within two (2) days after the first attempt to contact him/her via email or if he/she fails to sign and return the affidavit of eligibility and liability/publicity release within the required time period, if applicable, an alternate entrant will be selected in his/her place at random from among all eligible entries received.

7. Prizes: Twelve randomly selected eligible entrants will each receive one (1) "spa intoxification" prize package TBD each month. Approximate Retail Value of each prize is under $575. This will be a spa package, determined by the spa, which will be awarded to the winner and to be used within a certain time frame, as determined by the spa. Winners are solely responsible for all federal, state, and local taxes and other fees associated with prize receipt and use, should the prize exceed $599. No other substitution, assignment or transfer of prizes permitted, except by Sponsor.

8. Publicity: Except where prohibited, participation in the Sweepstakes constitutes winner's consent to Sponsor's use of winner's name, likeness, photograph, voice, opinions, biographical information, hometown and state for promotional purposes in any media without further payment or consideration.

9. General Conditions: Sponsor reserves the right to cancel or modify the Sweepstakes if fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity of the Sweepstakes, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prizes at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules, or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage any web site or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

10. Release: By entering this Sweepstakes, entrant agrees to release and hold harmless, spa-addicts.com, and any additional promotional partners, each of their related companies, and each of their respective officers, directors, employees, and agents from and against any losses, damages, rights, claim or cause of action of any kind arising, in whole or in part, directly or indirectly, out of participation in the Sweepstakes or resulting directly of indirectly, from acceptance, possession, use, or misuse of any prize awarded in connection with the Sweepstakes, including without limitation personal injury, death, and/or property damage, as well as claims based on publicity rights, defamation, and/or invasion of privacy.

11. Limitations of Liability: Sponsor is not responsible for: (i) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (ii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iii) unauthorized human intervention in any part of the entry process or the Sweepstakes; (iv) electronic or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (v) any injury or damage to persons or property, including but not limited to entrant's computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Sweepstakes or receipt of any prize awarded (vi) the guarantee of satisfaction when experiencing the prize package.

12. Disputes: Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, other than the administration of the Sweepstakes or the determination of winners shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the appropriate State Court located in New Jersey; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys' fees; and (iii) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New Jersey, without giving effect to any choice of law or conflict of law rules (whether of the State of New Jersey or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New Jersey.

13. Non-Endorsement: The use of any non-Sponsor trademark, service marks, logos or other marks in connection with this Sweepstakes or any prize is not meant by Sponsor to imply the endorsement of the respective owner(s) of such marks, or any affiliation of the respective owner(s) of such marks with the Site or the Sweepstakes.

14. Entrant's Personal Information: Information collected from entrants is subject to the Spa-addicts.com Privacy Policy.
